Valynne Bowers Pleads Guilty

Valynne Bowers, 41, is the second of two teachers to plead guilty to having sex with the same underage student at Bountiful Jr. High School. She plead guilty on Feb.14, 2011, to two counts of forcible sex abuse, a second-degree felony and will be sentenced April, 4, 2011 before Judge John Morris. She faces a possible 1 to 15 year sentence on each count. The student was 14 years old at the time of the abuse. Before the plea bargain was reached Bowers was charged with 5 counts of rape and 3 counts of forcible sodomy – all 1st degree felonies – and faced a possible life sentenced if convicted. Linda Nef, 48, the other teacher involved with the boy, pleaded guilty to attempted aggravated sexual abuse of a child. The boy was only 13 years old when the abuse began. She has been sentenced to 3 years to life.

While both the prosecution and the defense called the deal a good one, they were each hoping the judge would hand down very different sentences.

Valynne Bowers’ defense attorney, Rich Gallegos, called it a “fair resolution.”

“I think it’s good for the victim. It’s good for Valynne,” he said. “I think it’s middle of the road.”

“She’s made some strides while this case has been pending and we’re going to ask the court to consider probation,” he said.

Prosecutor Rick Westmoreland concurred that it was a good resolution to the case.

“This was a deal when it was all said and done, it was the best-case scenario for everybody involved. I think it was best for our victim. … It protected him from having to get on the stand,” he said.

“We’re going to be asking for prison,” he said. “We think this is a matter that it should be a prison case.”

Bowers faces a possible sentence of one to 15 years for each count. Prosecutors said they intend to ask for the maximum penalty on each and that the sentences run consecutively, meaning she could be sentenced to 30 years in prison. What eventually happens to Valynne Bowers will be in the hands of Judge John Morris who will preside over her sentencing on April 4, 2011.
